Trademark & Logo Policy

  1. Introduction
    1. ISN Software Corporation (“ISN”) is the owner of common law and statutory trademark rights in and to several trademarks, service marks, and logos, including the marks identified below (collectively, the “ISN Marks”) in the U.S. and internationally covering a variety of goods and services, including the provision of software and services relating to the management of vendors, suppliers, and contractors. ISN has invested substantial time, money, and effort in promoting the ISN Marks among consumers and businesses and establishing an association between the ISN Marks and ISN’s business offerings and reputation for providing quality services.
    2. ISN takes great care in the development and protection of its trademarks and reserves all rights of ownership of its trademarks. Any improper, confusing, or unauthorized use of the ISN Marks in any medium is likely to affect our reputation and image and is strictly prohibited. To report misuse of an ISN Mark, please contact ISNlegal@isn.com.
    3. This ISN Trademark and Logo Usage Policy (this “Policy”) governs the use of the ISN Marks by external, third-party organizations, such as vendors, customers, and partners, and explains the proper way to refer to ISN and the limited extent to which authorized third parties may use the ISN Marks.
    4. ISN carefully limits the use of the ISN Marks. Third parties may use the ISN Marks only in accordance with applicable sections of this Policy or as otherwise indicated in writing by ISN.
    5. The following is a non-exclusive list of trademarks owned by ISN. Those trademarks followed by the ® symbol are registered in the United States and may also be registered in other countries. Those trademarks followed by the ™ symbol are trademarks of ISN in the United States and other countries.

  2. General Trademark Use Policy
    1. The ISN Marks may not be used by any third party except as expressly set forth in this Policy or in a written agreement with ISN. ISN retains ownership of all intellectual property rights related to the ISN Marks and any use of the ISN Marks inures solely to ISN’s benefit.
    2. Fair use of ISN trademarks. The ISN Marks include the famous ISN orange logo and other designs and logos as well as text-only product and service names. “Fair use” of ISN trademarks, that is, use by a third party without express permission or license, is limited to text-only references to ISN trademarks such as product and service names, and excludes ISN logos and design marks. Third parties may generally use the ISN Marks to accurately refer to or describe ISN’s products or services, as long as customers and the public will not be confused into believing ISN is affiliated with or endorses any third-party product, service, or company. The following are two common types of fair use:
      • When specifically referring to ISN products, e.g., ISNetworld tools can help improve workplace safety;
      • When indicating that an ISN product is compatible with another product, e.g., XYZ is compatible with ISN compliance products.
    3. The ISN Marks permitted for third-party use may not be used in any manner that, in ISN’s sole opinion, disparages ISN or its services or products, infringes ISN's intellectual-property rights or this Policy, creates confusion, is obscene or otherwise objectionable to ISN, or violates any state, provincial, national, or international law.
    4. Use of any of the ISN Marks in a confusing manner or in such proximity to any third party’s trademarks so as to create a combination or composite mark is not allowed.
    5. Use of any or all of the ISN Marks in a manner that blurs, tarnishes, dilutes, or otherwise weakens the acquired distinctiveness of the ISN Marks is strictly prohibited.
    6. Any authorized third-party use of the ISN Marks immediately terminates upon written notice from ISN or when such third party’s affiliation with ISN has ceased.
  3. Rules for Proper Use of the ISN Marks
    1. Always distinguish the ISN Marks from surrounding text in some way – e.g., capitalize the entire mark, capitalize the first letter of the mark, or use a different font or color for the mark than for the generic name.
    2. The first reference in text to all ISN product names should be preceded by ISN and followed by the proper trademark symbol. Rules for marking product names differ by country. In the United States, use the ® symbol in connection with any registered trademarks, e.g., the ISNetworld® platform, and use the superscripted letters ™ in connection with any other ISN marks, e.g., the ESG ASSURE™ services. If it is not clear that a trademark is registered, please use the ™ symbol.
    3. Except when using “ISN” as a company name, always use an ISN Mark as an adjective qualifying a noun that is a generic description of the product or service, never as a noun or verb, and never in the plural or possessive form. Never use an ISN Mark in a way that suggests a common, descriptive, or generic meaning.
      NOTE: “ISN”, the 3 letters in text, is both a trademark of ISN Software Corporation and an abbreviation of its company name. When “ISN” is used to identify the company, ISN Software Corporation, it is called a trade name. Trade name usage typically applies when referring to a company as opposed to a particular product. It is permissible to use ISN as a possessive if you are referring to ISN the company. In that case the name does not identify goods or services (which are legally the domain of trademarks).
    4. Do not create any new logo for ISN or ISN product names. Never alter an ISN Mark or incorporate an ISN Mark (or a mark confusingly similar to an ISN Mark) with third-party product names, service names, trademarks, logos, or company names.
    5. Never use an ISN Mark (or a mark confusingly similar to an ISN Mark) as part of a domain name or email address.
    6. Never display an ISN Mark an excessive number of times, as a prominent element, or as an “attention-getting symbol” in advertising and promotional material, including on websites, online ad text, or in metatags. Do not use ISN taglines (e.g., Collect. Verify. Connect.®).
    7. The first use of each ISN product name mentioned in communications must be identified in a footnote or attribution. Where appropriate, place an asterisk adjacent to the ISN Mark and place an appropriate notice at the bottom of the page or screen on which the asterisk appears, or in the legal section of the communication or site in which it is referenced. Examples:

      *ISN®, ISNetworld®, RAVS®, T-RAVS™, and MSQ™ are trademarks or registered trademarks of ISN Software Corporation.

      OR

      *ISN®, ISNetworld®, and RAVS® are registered trademarks of ISN Software Corporation.

      NOTE: Depending on which ISN Marks are being used, the above notices will need to be modified accordingly.

  4. ISNetworld Data Provider Logo
    1. Third parties with a signed ISNetworld Data Provider Agreement in place may use the ISNetworld Data Provider logo (“Data Provider Logo”) in any medium (including, but not limited to, on the Data Provider’s website and print materials, such as brochures, business cards, and stationery) as stipulated in, and subject to the terms of, the written ISNetworld Data Provider Agreement and this Policy.
    2. An ISNetworld Data Provider may only use the Data Provider Logo in connection with the category of services authorized in its ISNetworld Data Provider Agreement (e.g., an ISNetworld Data Provider providing training data may only use the Data Provider Logo in connection with training services, but may not use the Data Provider Logo in connection with Operator Qualifications services without providing Operator Qualification data into the ISNetworld® platform).
    3. When used online or in an electronic communication, the Data Provider Logo must be hyperlinked to the ISNetworld® website (www.isnetworld.com) at all times.
    4. The Data Provider Logo may be used only as depicted below. The Data Provider Logo may not be modified or altered in any way or be used in a confusing manner.
    5. In the event the ISNetworld Data Provider Agreement expires or terminates, or otherwise upon written notice from ISN, the Data Provider must immediately cease, in any and all media (including, but not limited to, on websites and print materials), any and all use of the Data Provider Logo, the ISN Marks, and any other ISN trademarks, service marks, or logos.

  5. ISNetworld Member Contractor Logo
    1. As an added benefit to its Member Contractors, ISN provides and encourages the proper use of the ISNetworld Member Contractor logo (“Contractor Logo”) by active ISNetworld Member Contractors in any medium (including, but not limited to, on the Member Contractor’s website and print materials), as stipulated in this Policy.
    2. When used online or in an electronic communication, the Contractor Logo must be hyperlinked to the ISNetworld® website (www.isnetworld.com) at all times.
    3. The Contractor Logo may be used only as depicted below. The Contractor Logo may not be modified or altered in any way or be used in a confusing manner.
    4. In the event the Member Contractor’s ISNetworld® account is not in good standing (e.g., unpaid invoices), the Member Contractor’s ISNetworld® subscription expires or terminates, or otherwise upon written notice from ISN, the Member Contractor must immediately cease, in any and all media (including, but not limited to, on websites and print materials), any and all use of the Contractor Logo, the ISN Marks, and any other ISN trademarks, service marks, or logos.

  6. ISNetworld Registered Insurance Agent/Broker Logo
    1. Third parties that have agreed to the ISNetworld Online Insurance Agent/Broker Registration Agreement may use the ISNetworld Registered Insurance Agent/Broker logo (“Agent/Broker Logo”) in any medium (including, but not limited to, on the Insurance Agent/Broker’s website and print materials) as stipulated in, and subject to the terms of, the ISNetworld Online Insurance Agent/Broker Registration Agreement and this Policy.
    2. When used online or in an electronic communication, the Agent/Broker Logo must be hyperlinked to the ISNetworld® website (www.isnetworld.com) at all times.
    3. The Agent/Broker Logo may be used only as depicted below. The Agent/Broker Logo may not be modified or altered in any way or be used in a confusing manner.
    4. In the event the Insurance Agent/Broker’s ISNetworld® account is terminated, or otherwise upon written notice from ISN, the Insurance Agent/Broker must immediately cease, in any and all media (including, but not limited to, on websites and print materials), any and all use of the Agent/Broker Logo, the ISN Marks, and any other ISN trademarks, service marks, or logos.

  7. Third-Party Consultants
    1. Any third party claiming to provide consulting services or other assistance to ISNetworld® customers must comply with the terms of this Policy.
    2. Prominently (in bold type and in a size no less than the majority of text appearing on the materials, but in no event smaller than 12pt font) display the following disclaimer on websites and any other promotional or marketing materials that reference ISN, ISN’s ISNetworld® platform, or use any ISN Mark:

      [Insert third-party consultant name] is in no way endorsed, sponsored, approved by, or otherwise affiliated with ISNetworld®.

    3. All uses of the ISN Marks must comply with the rules and restrictions set forth in Sections 2 and 3 or elsewhere in this Policy.
    4. The ISN Marks should not be used as part of search engine key words or sponsored links or used in metatags or ad text
    5. Never imply, suggest, or otherwise indicate–whether on the phone, in emails, on websites, in advertising or promotional materials, or otherwise–that a third-party consultant represents, is affiliated with, or has any other relationship to ISN.
    6. Never imply, suggest, or otherwise indicate that ISNetworld® customers and contractors: (a) cannot fulfill ISNetworld® requirements on their own, or (b) must utilize the services of a third-party consultant in order to fulfill ISNetworld® requirements.
    7. Never depict–whether on the phone, in emails, on websites, in advertising or promotional materials, or otherwise–ISNetworld®, the ISNetworld® compliance process, or any ISN product or service in a negative light. For example, do not use phrases such as “ISNetworld® Problems” or “ISNetworld® Problems…Call Us.”
    8. Never incorporate an ISN Mark (or mark confusingly similar to an ISN Mark) with third-party product names, service names, trademarks, logos, company names, browser title bar, domain names, or email addresses.
    9. If services are also provided to customers other than ISNetworld® customers, then this should be reflected on such third-party consultant’s website and other advertising and promotional material, equal treatment should be given to each such organization, and neither ISN nor the ISNetworld® platform should be singled out.
  8. Deep Linking or Framing the ISNetworld® Website
    1. Deep linking or framing the ISNetworld® website or altering the way in which the ISNetworld® website or its content is viewed is not allowed. Framing generally means causing third-party content to appear above, below, beside, or around the ISNetworld® website. Deep linking generally means including a link to a specific ISNetworld® webpage instead of the ISNetworld® website’s main or home page.
  9. Use of ISNetworld® Webpage and/or EMPOWER™ Screenshots
    1. The use or placement of ISNetworld® webpage and/or EMPOWER™ screenshots on third-party websites or apps without prior written permission is prohibited.
  10. Domain Names Containing ISN Marks
    1. While it has become very popular to register, use, and sell domain names, it generally is not permissible to own, sell, or use a domain name which contains a trademark owned by another person or company.
    2. ISN owns exclusive trademark and service mark rights to the ISN Marks. The ownership, use, or sale of a domain name that contains any of the ISN Marks, including, but not limited to, ISNetworld®, RAVS®, and ISN®, is prohibited.
  11. Search Engine Key Words, Sponsored Links, and Ad Text
    1. The ISN Marks should not be registered or used as search engine key words or sponsored links or used in metatags or ad text if the registration or use is misleading, causes confusion, or suggests that ISN is involved with, sponsors, endorses, approves of, or is otherwise affiliated with the third party.
